The family of a teenage bicyclist who died after being hit from behind by an SUV is now being sued for more than $1 million by the woman who was behind the wheel.

Sharlene Simon claims in court papers the accident caused her “great pain and suffering” and accuses her victim Brandon Majewski 17, and his two friends of negligence, calling them “incompetent bicyclists,” the Toronto Sun reported Friday.

The lawsuit drew an angry response from Brandon's family. “I feel like someone kicked me in the stomach -- I’m over the edge,” his father, Derek Majewski, told the Sun. “Sometimes, it makes my blood boil.”

The dad's attorney Brian Cameron told the Sun that in all his years as a lawyer, he had never seen anyone ever sue a child that they killed. “It’s beyond the pale,” he said. He is representing the elder Majewski in a seperate lawsuit that seeks $900,000 in damages from Simon.

The accident happened early in the morning of Oct. 28, 2012, on a dark, rural road in Innisfil, about 55 miles north of Toronto. Brandon’s two friends were both 16. One was seriously injured; the other escaped injury. They are also defendants in Simon’s lawsuit, as is the county where the accident occurred.

Simon, a 42-year-old mother of three, said she was going about 55 mph in her KIA Sorrento when she hit the boys -- about 5 mph more than the speed limit, the Ottawa Citizen said. No criminal charges were ever filed against her.

“It’s a tragedy what happened to the boys, but it’s also a tragedy that’s happened to (Simon),” her lawyer Michael Ellis told the Toronto Star. “I understand their grief and I understand what they must be going through is awful, but my client is also living with this nightmare every day.”

  • Everything seems to be going upside-down, inside-out, and bass-ackwards with

this "I don't care, I'm entitled to mo' money" crap. Frivolous lawsuits have been

getting more and more outrageous every year.

  • Thanks Obama!

  • No wonder Canada's middle class has passed ours.

  • I wonder if I could retire in Canada. Too damn cold though

Go for Australia. It's pretty warm there, and they speak English (sort of).

I've been to Perth a few times onboard ship. Had a blast.

  • I'd retire to Australia in a second if I could. I'll probably make do with south Carolina.though

  • Screw it. I'd do a lot of traveling but even if I won the fuck you money I would stay here in Ohio.

In the summer, sure, but once October got here I'd be in Arizona

Give me someplace in a Goldilocks zone. All this up and down weather triggers my migraines.

  • Shit on the summer. I despise hot humid weather. I might spend part of July or August by the Hudson Bay.

It's a rare occasion that the cold really bums me out and mostly that's only when the roads get shitty. Give me 55-65 and sunshine.

  • I remember shivering in the 5:30 am morning in basic in Texas.

Then marching forever carrying our coats and gloves, getting

    sweatied up.

And in Miami, going on a cruise? Getting off the bus to the un-air conditioned

    port building?

Like an oven. Ohio is pretty cool, I love the change of seasons.

Our friends in N.C. love the more moderate temps in the winter.

  • Lately I have hated both summer and winter. If I could live in perpetual Autumn I'd be all over that.

  • I went on vacation to Cancun one winter. We left Cleveland it was 15 degrees. When we landed in Cancun it was 85. That is heaven for me

  • The fuck you money would land me right here in the Commonwealth (not NOVA, as it is another world entirely). I'd travel, sure, but home base would be, well, home.
