  • Legal Loophole In Art Modell's Will Eliminates Cleveland Browns Forever

    BALTIMORE—Exploiting a legal technicality that allowed him to regain full ownership of the Cleveland Browns organization in death, former team owner Art Modell specified his wish to permanently dismantle the 66-year-old franchise in his last will and testament, family sources reported Tuesday. “It is my dying wish that the Cleveland Browns football team and associated assets be liquidated and distributed amongst the benefactors listed herein,” read part of the document, in which Modell also stripped the franchise of its right to the team’s colors, which the Baltimore Ravens will adopt for their second alternate uniforms beginning next season. “Furthermore, I hereby set aside funds in the amount of $50 million for the creation of a nonprofit foundation dedicated to ensuring that no professional football team moves to or is ever established in the city of Cleveland, from now until the end of time.” At press time, sources confirmed Modell had bequeathed the Browns’ 1964 NFL championship to LeBron James and ordered the immediate demolition of the Rock and Roll Hall of Fame.

    Actually he has a 1% or 1/31st. He would have had the other 99% owner go along with him.

    I will write that will for you if you'd like. A person can put anything in a will they want....but, such a will can only legally dispose of the assets that the decedent actually has an interest in. Anything else is obiter dicta.

    You do bring up an interesting question though: What contingency plan does the NFL have in place if a disaster of that nature should occur? I suspect they would find "replacement" players if the event happened in the middle of a season. Then later they would probably hold a disbursement draft similar to an expansion situation.

    I have written probably a couple thousand wills over the years.

    If there is to be any frivolous BS in it, it would be because you wanted it in there. And you would be given the advice that it is indeed frivolous.

    And, fyi, the frivolous part would simply be ignored with the appropriate parts being effectuated. And the court's take nothing from no one. If there is a dispute over where assets should go, that dispute would be between the putative heirs. If there is no dispute, those heirs will get their shares notwithstanding whatever other BS may appear in the will.

    The question is whether or not what you put in there is BS.

    Example, if you give 50% of your net estate to your dog and 50% to your kids an issue may arise as to whether the dog is legally entitled to have his "share" set up in a trust for his benefit, or whether it is legal for a dog to inherit in derogation of other "human" heirs rights. It may all depend on the laws of your state. In Ohio, beneficiaries must be humans...or charitable entities.

    However, if you create an inter vivos trust, and fund that trust, and name a trustee to be the recipient of those funds and give that trustee the duty to apply those funds for the maintenance and welfare of that animal, that is enforceable.

    So, in lieu of writing your will, I will prepare a trust for you....and you can leave your assets for the care and maintenance of all the members of The Dawg Pound.

    $1500.00 will get it all done for you, including your pour over will.

    However, I cannot draft a living will or a DPAHC for your dog.
