It is protected speech under 1A, in my opinion. What does the board think?

By that logic, you're cool when a Muslim beheads someone because they drew a picture of Mohammed?

That's totally not the same logic.

The same logic would be if someone leaves tire marks on a BLM or rainbow street painting and gets arrested for it. Which the left has a double standard for.

Calling those things hate crimes is bullshit. So how about we get rid of the bullshit instead of expanding what it applies to?

Only you decapitated someone in your example lol, that's far from a hit or an ass kicking. It also dealt with a terroristic action with a foreign ideology not in the spirit of defending our country which is ingrained in people especially those that served to honor and protect the flag and what it represents. In this country, maybe it's time we start finding reasons to defend it instead of looking for reasons to tear it down. I think this is the the spirit in which Trump is trying to get at.

I voted should not be illegal so long as it's a flag you bought and paid for.

Though I go with the caveat that if you are not a citizen then there should be punishment plus automatic deportation to our destination of choice.

I do believe the core issue is that the burning of the flag is done so to incite a riot.

what other purpose is there for burning the flag?

if you want to go in your backyard and burn your flag have at it loser.

i dont think there should be zero tolerance policy on burning the flag

guns don't kill kids-pitt bulls do.

There is no escape from consequence for actions taken, or even spoken as per 1st amendment rights. Talk shit / get hit is different than do shit / get hit.  I side with the liberty I might choose to take. And it might include violence with prejudice.  Sorry not sorry

well, I voted "yes". Because - free speech is one thing, but yelling "FIRE" in a crowded theater is NOT.

                                     Where is the line drawn?

The question needs clarification. Burning our American flag in private - who cares? nobody knows.

but burning our American flag in front of a crowd, in front of a veterans day assembly, etc etc, is openly inciting offense and tentatively inciting violence.

The left demands to own definitions of words that THEY create. "hate crime" means what they espouse has been offended.

But if they hate our American flag, hate our country, hate republicans, hate Christians, hate God, hate everything else they don't like......

that is ok because THEY decide what is allowed to be hated, and they feel no crime against what they hate is unjustified.

They love their illegals, so they feel the accompanying violent crimes are not to be talked about, even ignored/ridiculed.

But wait til someone burns a gay pride flag? Then all leftwing liberal outrage ensures.

Liberals want our American flag to be allowed to be burned as "free speech".

Not in public it is not.

Simply put - to liberals, burning flags is only free speech when liberals decide it's free speech.

I believe burning flags in public is yelling "FIRE" in a crowded theater. It's meant to induce panic, terror and violence with an entire crowd trying to get out the doors.

On PRINCIPLE - burning symbolic flags in public should be considered deliberately "inciting to riot".

And yes, so many of our military fought and died died for our American flag - and in public, a "citizens arrest" should be a given. With violence if necessary.

But as always, the left's hypocrisy is there for all America to see.

                                    This starts a slippery slope.

Freedom of speech is a powerful right, while I agree with everyone's spirit in wanting to ban burning the American flag, being able to burn it is equally in the spirit of our country.

If you are not a US citizen, then burning our flag in our country should bring punishment and/or being deported.

How is that a circular argument? You abide by talk shit, get hit. Answer the question, should burning the American flag be illegal?

                                        Then we are in agreement.

I do believe the core issue is that the burning of the flag is done so to incite a riot.

what other purpose is there for burning the flag?

if you want to go in your backyard and burn your flag have at it loser.

Who gets to decide if it's inciting a riot or not? There was a retired vet who, earlier this week, burned the flag in protest of Trump's announcement and accepted his arrest for it. He wasn't starting a riot. He was making a political statement. He's going to end up winning a big settlement from the US taxpayer because of it.

yelling "FIRE" in a crowded theater is NOT.

This argument is wrong and only ever gets used by people who want to take away free speech rights. The courts ruled that the act of "yelling fire" cannot be illegal in and of itself. It can be yelled for a lot of reasons. The courts set a very high bar for when doing so would be illegal, and that would be in the case of speech that is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action."

Best of luck proving that intent in court. Going to be a massive waste of taxpayer dollar if we try to prosecute everyone who burns the flag on those grounds.

Talk shit / get hit is different than do shit / get hit.  I side with the liberty I might choose to take. And it might include violence with prejudice.  Sorry not sorry
