Only you decapitated someone in your example lol, that's far from a hit or an ass kicking. It also dealt with a terroristic action with a foreign ideology not in the spirit of defending our country which is ingrained in people especially those that served to honor and protect the flag and what it represents. In this country, maybe it's time we start finding reasons to defend it instead of looking for reasons to tear it down. I think this is the the spirit in which Trump is trying to get at.
I voted should not be illegal so long as it's a flag you bought and paid for.

Who gets to decide if it's inciting a riot or not? There was a retired vet who, earlier this week, burned the flag in protest of Trump's announcement and accepted his arrest for it. He wasn't starting a riot. He was making a political statement. He's going to end up winning a big settlement from the US taxpayer because of it.

It can be yelled for a lot of reasons. The courts set a very high bar for when doing so would be illegal, and that would be in the case of speech that is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action."
Best of luck proving that intent in court. Going to be a massive waste of taxpayer dollar if we try to prosecute everyone who burns the flag on those grounds.
