The question needs clarification. Burning our American flag in private - who cares? nobody knows.
but burning our American flag in front of a crowd, in front of a veterans day assembly, etc etc, is openly inciting offense and tentatively inciting violence.
The left demands to own definitions of words that THEY create. "hate crime" means what they espouse has been offended.
But if they hate our American flag, hate our country, hate republicans, hate Christians, hate God, hate everything else they don't like......
that is ok because THEY decide what is allowed to be hated, and they feel no crime against what they hate is unjustified.
They love their illegals, so they feel the accompanying violent crimes are not to be talked about, even ignored/ridiculed.

Simply put - to liberals, burning flags is only free speech when liberals decide it's free speech.
I believe burning flags in public is yelling "FIRE" in a crowded theater. It's meant to induce panic, terror and violence with an entire crowd trying to get out the doors.
On PRINCIPLE - burning symbolic flags in public should be considered deliberately "inciting to riot".
And yes, so many of our military fought and died died for our American flag - and in public, a "citizens arrest" should be a given. With violence if necessary.
But as always, the left's hypocrisy is there for all America to see.

Who gets to decide if it's inciting a riot or not? There was a retired vet who, earlier this week, burned the flag in protest of Trump's announcement and accepted his arrest for it. He wasn't starting a riot. He was making a political statement. He's going to end up winning a big settlement from the US taxpayer because of it.

This argument is wrong and only ever gets used by people who want to take away free speech rights. The courts ruled that the act of "yelling fire" cannot be illegal in and of itself. It can be yelled for a lot of reasons. The courts set a very high bar for when doing so would be illegal, and that would be in the case of speech that is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action."
Best of luck proving that intent in court. Going to be a massive waste of taxpayer dollar if we try to prosecute everyone who burns the flag on those grounds.

And if the government makes an exception to do it for one cause (such as the American flag), there's not a lot stopping them from making an exception for other causes when other groups have that power (Muslims and the Quran, liberals and the pride flag, etc). The moment it doesn't apply to certain opinions is the moment it becomes worthless.

SCOTUS has clearly defined the limit of 1A with speech "directed to inciting or producing imminent lawless action and is likely to incite or produce such action." That's where I draw the line.

Something being outrageous or causing anger isn't illegal. Intimidation falls outside of 1A only when a true threat is attached to it.

I voted no. At the end of the day it’s an innocuous act that’s meant to be an attention getter and a conversation starter. So l see you’re upset with America. Tell me all about it.
With pretty much everything l try to look past the act to the motivations behind the act. If someone is fired up enough to burn our flag in public view, they are obviously looking to be seen and heard. If they don’t get seen or heard, they’re liable to step up their game and get our attention in other ways. Flying a plane into a building? Setting off a bomb? Driving a truck through a crowd? Shooting a gun in to a crowd?
We’ve witnessed those things, and I’ll take a burning flag 10 outta 10 times over those things. As weird as it sounds, it’s a positive in two ways. 1) we care enough as a nation that it upsets us enough that we are even having this conversation, and 2) we have thick enough skin to allow it because we can absorb people blowing off steam without losing our shit over it and escalating it further.
