    Are you ok with that guy getting 15 years for burning a gay flag? 

    Let's try to differentiate between outrageous, intimidating/angering actions designed for that purpose, and honest speech someone doesn't like/finds offensive.

    SCOTUS has clearly defined the limit of 1A with speech "directed to inciting or producing imminent lawless action and is likely to incite or produce such action." That's where I draw the line.

    Nope. That punishment is a clear violation of 1A, imo. This is why I can't stand "hate speech" being used as justification to shut people up.

    Something being outrageous or causing anger isn't illegal. Intimidation falls outside of 1A only when a true threat is attached to it.

  • I voted no. At the end of the day it’s an innocuous act that’s meant to be an attention getter and a conversation starter. So l see you’re upset with America. Tell me all about it. 

    With pretty much everything l try to look past the act to the motivations behind the act. If someone is fired up enough to burn our flag in public view, they are obviously looking to be seen and heard. If they don’t get seen or heard, they’re liable to step up their game and get our attention in other ways. Flying a plane into a building? Setting off a bomb? Driving a truck through a crowd? Shooting a gun in to a crowd? 

    We’ve witnessed those things, and I’ll take a burning flag 10 outta 10 times over those things. As weird as it sounds, it’s a positive in two ways. 1) we care enough as a nation that it upsets us enough that we are even having this conversation, and 2) we have thick enough skin to allow it because we can absorb people blowing off steam without losing our shit over it and escalating it further.

    I'd only refer to his post of which I responded with the "TY" symbol because my response was not equal to your example of a beheading. Not unusual for a radical muslim but certainly for  US flag loving persons like many of us, there is no equity. And this here pitting burning a pride flag with a vengeful marxist.   • When its all said and done i think the President knows it’ll be shot down, but it should add some discomfort to the losers who would love to cause trouble and sow discontent among other losers.

  • When its all said and done i think the President knows it’ll be shot down, but it should add some discomfort to the losers who would love to cause trouble and sow discontent among other losers.

    If our flag being burned by a guy at a protest sends you into a blind rage, uncontrollable anger, etc where those around you are in the same level of danger as if they were on a panicked crowd trying to leave a theater, then you're the problem. You're a thin skinned snowflake. 

    You don't have a right to not be offended, princess. 

    You continuing to equate this to "yelling fire in a theater" doesn't make it any more legitimate of an argument each time you say it. They're not the same thing. Anyone not completely politically blinded or riddled with dementia can see that
