Get all that both Mud and you posted... but I think we are dealing with two different jurisdictions here... Yes?
Right....2 jurisdictions.....Dallas and Fort worth....
Fort Worth determined that no assault happened "in their jurisdiction"....and closed case
Dallas said no charges filed and case closed "because there was no complaint filed"....(and now there is)
Here is a timeline link that lays out the whole episode ....

That could be. But don't you think a police officer could get himself into a world of shit by letting someone go who is completely blotto? And if there was evidence that shed been as severely beaten as she said and the cops turned a blind eye? That sound reasonable or logical? If what Manziels' girlfriend said was true and she asked the valet for help and he said he didn't know what to do, my question is why didn't he know what to do? If he feared for his own safety couldn't he have called 911 after they left? Or was he concerned about Manziel being a celebrity? What was his reasoning that he had to stand back and do nothing when she asked him for help and said she was fearful for her safety?
I never agreed with Manziel not getting a breathalyzer test by the police on the incident with his girlfriend where he was driving recklessly, speeding and admitted to drinking earlier. I don't see too many average citizens not getting at least a breathalyzer test under those circumstances. I believe it was just his celebrity status and he got different treatment than the average citizen.
PS I have been given a few field sobriety tests but only one breathalyzer.

Severely beaten???....doubt it.....but both she and a witness said that there was a physical altercation....and I do believe there are situations where the police would turn a blind eye....and believe that some people(sport stars, etc) get special treatment....all the time, actually....
Watch Cops.....whenever there is a domestic situation that turns physical, someone ALWAYS goes to jail....its the law....(Ohio is one of the 21 states)
The American Bar Association has identified 21 states with mandatory arrest for domestic violence assault (1). On their face, many of the laws appear to be consistent with Fourth Amendment probable-cause requirements. But the actual enforcement of such laws is typically based on a weaker standard than probable-cause:
- Training programs for law enforcement personnel often emphasize the need to “err on the side of caution,” “hold abusers accountable,” and “give first priority to protecting victims,” admonitions that in practice mean, “Always believe the accuser” (2).
- Training programs often use biased terminology, e.g., use the word “victim” instead of “accuser,” and omit the word “alleged” before “abuser” (2).
- Predominant aggressor policies serve to predispose law enforcement personnel to assume the instigator is the male (3).
- In one state, law enforcement officers are instructed to view a man’s statement that “She hit me first” as an “excuse” (4).

I don't believe Manziel even got field sobriety tests on the incident?

The valet should have called the police and made a report. There is no question in my mind I would have done it even if I didn't fully believe the girlfriend because I could not take the chance. I would have made the report and let the police investigate.
“I was crying and begged the valet, ‘Please don’t let him take me. I’m scared for my life!'” she told police. The valet reportedly told her, “I don’t know what to do” and let Manziel leave with her.
I am not clear on who called the police maybe the valet did (I hope he did anyway). You just cannot do nothing when you witness something like this.

Just don't blame Zombo and his winks thrown about these United States causing friction between happy couples.

My answer would be (even if I wasn't sure or didn't believe the girlfriend) is that the girlfriend said she was fearful for her safety and asked me not to let him take her and I wanted the police to investigate to be sure. I didn't want to make the decision if she was being truthful or not. If someone tells you something like this you about have to take them at their word (at the time).

Im with you OBF....if I witnessed an altercation between a woman and a man and the woman was pleading for help, then how can you NOT respond?.....either help her or make a call....IF that really happened, then it was a puss move on the part of the valet.....
Lots of people let bad shit happen because they dont want to get involved(or are just afraid).....a shame, really

All the news coming out about JM makes me think of this

-
OK..... explain how that works.....and what would be done.
Good question. If he had a broken leg and couldn't play we still have to pay him. Of course we might be able to put him on PUP and save a roster spot?

Steve, I'm thinking should the NFL suspend Manziel indefinitely (and that would be without pay) it's the exact same situation as Josh Gordon.
Now whether or not the Browns could cut him while he's suspended- that's another matter entirely.

After a further personal investigation Zombos story checks out. He did leave some things out tho.
Zombo winks at Colleen. Colleen was immediately induced by her female hormones and had an orgasm. For thanking Zombo she winks back. Zombo then leaves the scene and Colleen was trying to explain herself when Johnny then called Zombo a name.

In court, what he believes or thought isnt at issue......only what he "saw" or witnessed....
His motives for not calling police or not helping are inconsequential....
All he has to say is "I didnt want to get involved"....

If Manziel had hurt or killed his girlfriend the question being asked by the police to Mr. Rodriguez would be "why didn't you call and report this?. Didn't she tell you she feared for her life? Didn't she ask you to help her?"
Mr. Rodriguez himself might get criminal charges for failing to make a report as Manziel's girlfriend was stating she was being taken against her will by Manziel. The girlfriend is reporting a crime as you cannot take someone against their will. In many states failure to report a crime is a crime itself.
It is the job of the police here to make the call if the girlfriend is truthful or not. The valet has a responsibility to report a crime but not to investigate one. The police will interview the girlfriend and Manziel and make the decision if there are to be criminal charges (although they may call the prosecutor for legal advice as to what possible charges are involved).

Isn't there a Samaritan Law somewhere? And his involvement wouldn't have to be anything beyond just calling the cops.
I think that's what a normal person would do in that situation. I'm not suggesting he fight him.

But its not a crime in Texas...it's called "Duty to rescue" and is only enforceable in 10 states....and has a lot of language making it very difficult to enforce...
Well if you don't think that's relevant I think youre dreaming but stranger things happen. I would think his reasoning for not responding to what she said was a dangerous situation will be very relevant.
What do you think Gipper?
Im interested what Gipper says too....but Id think the court doesnt care about an individuals "opinion" of what was happening or would use a valets opinion as an expert opinion....maybe he's just a cowardly dumbass...
usually opinions are hearsay and facts are the only allowable testimony....
I think all he has to do is confirm her version of events....basically, that she asked him for help and he didnt respond.....because if a woman is asking for help, is it really up to the doorman to establish in court that she didnt need it?....does his judgement somehow supersede hers in a court of law?....especially since she's the one in danger and he's just a bystander who knows nothing about the situation?
The valet is the only witness so his opinion on whether or not her story is credible is all we have to go on. Anyway that's what I'd ask if I was his attorney so...

His opinion wont make a difference. 10 people could witness something and all come away with different opinions.....why should his be the "credible one"???.....if she asked for help and he confirms that, then it adds credibility to her story...
-
I think we all agree the valet should have at least called the police and reported this when it happened. He told the girlfriend there was nothing he could do but he could at least have called 9-11 and reported to the police what the girlfriend had told him.
-
The valet was probably given hush money. There would be no other plausible explanation.
