    Yes indeed lots of factors. Including a police officers decision whether or not to have someone take a breathalyzer. Now I think we all realize that the police officers claim that a vehicle has been weaving or that he smells alcohol can most certainly the bullshit. Correct? So if the police officer actually did smell alcohol and refused to perform a breathalyzer it must mean something.

    It at least proves that everything is not that severely by the book.

    Police get a report of a driver going at a high rate of speed and driving erratically. When stopped the driver admits to have been drinking earlier and has a smell of alcohol on their person. Since when does a driver in this situation not get a breathalyser test? The officer takes the drivers word he only had a few drinks earlier? Why not take a minute and have the driver blow into a breathalyser and be sure? I heard a judge one time say he would be rich if he had a dollar for every time in a DUI case he heard that phrase in the courtroom of of the defendant saying they only had 2 drinks.

    I've been stopped, often in what seems to me, to be bogus situations. Usually because I'm driving home after a gig and would seem I was coming home from a bar. Which I am. But the bullshit excuse the cop gives is that I was weaving and he smells alcohol.

    I knew I was leaving a bar and I haven't had a drink all night in at least a couple situations. The officers seemed annoyed when I blew a 0.0.

    i've smelled like alcohol, had a moving violation and been let go many times based simply upon being honest, so have others i have witnessed firsthand.

    there are costs involved with investigating non-issues. the financial costs for the department for one, plus tying up courts with weak cases, overcrowded jails w nowhere to put real criminals in jails full of bad arrests, but most importantly while they're screwing around wasting time with a non-drunk who might blow .01 over there often is a tow involved, then deciding what to do with the other parties, plus pages and pages of paperwork (hours), unpaid court dates on their days off for charges that will probably get dismissed, while they are out there dealing with this non-issue half for their shift, hundreds of real crimes may have been committed.

    it's prioritizing for the greater good and i for one think it's a phenomenal thing. there is also the potential for a lawsuit against the officer and the department for jailing a citizen unjustifiably. in JFF's case if he was recognized as a celebrity, knowing how deep his pockets and resources are may have attributed more to his outcome than simple good will or playing favorites.

    if you got detained for nothing, there was probably a reason. wrong place at the wrong time is a big one. cops are like everyone else, most don't do more than they have to but if you are out and about when drunks are driving the streets, it's like being in a bad neighborhood alone after dark--you are effectively asking for it. JFF was out at 5:30-6PM btw, near hid gated golf course community, and looking for a wallet BSC girl had just thrown out, babysitting a hostile drunk. i'd believe him too.

    you guys sound as if you are directly persecuted in every instance, like the cops have a personal vendetta to bust people for anything. is that what it's like around you? no fucking way would i live in an environment like that, EVER. benefit of the doubt still exists in the world, i'd suggest seeking it out if this is really how you are being treated.

    That said, alcohol is only going to limit your ability to make the right decision regards your other issues, so he should be avoiding that too.

    Well when he was in a bathroom with a rolled up dollar bill it seems pretty obvious he was doing something else - cocaine, pills, whatever it may have been.

    But whatever he did in rehab is really only his business - not the public's business. But usually you don't selectively treat an addict - you want them to give up dependence to everything - including alcohol. I'm sure some people could stop using narcotics and keep drinking, but in a rehab program they want you to give up all of it usually.

  • sisky it doesn't need to be a police state if your municipality makes a nice healthy profit on DUI charges. I'm driving home from a gig at 2 o'clock in the morning odds most drivers at that time have been in a bar drinking. Cop wants to pick off an easy one. It doesn't happen every trip but it's happened two or three times.

    1 drunk driving charge probably pays the cop's salary for the week. And the lawyer's secretary.

    I've never watched any of them. I'm not surprised if he actually is making money. There's lots of no talent assclowns out there making money only because people are willing to watch what they do.

  • Again Manziel was not pulled over for nothing. He was pulled over on a report of driving at a high rate of speed and driving reckless. Then he was observed with a smell of alcohol on his person and he admitted to having 2 drinks earlier. It's common sense at this point the driver be made to do a breathalyser test and not just take his word on how much he had to drink. I see the commercials over and over that buzzed driving is drunk driving. Maybe that just applies to some.
